 Janssen Pharmaceuticals Inc. is a subsidiary of Johnson and Johnson. Janssen Pharmaceuticals manufactures the antipsychotic drug, Risperdal, which at one time was prescribed more than any other antipsychotic in the United States.

Risperdal has been in the news a lot lately due to multiple lawsuits claiming the drug causes serious side effects, including gynecomastia.  The claims are that Risperdal blocks dopamine and raises prolactin levels. The legal dispute is one of the longest in history against a pharmaceutical company.

In September of 2012, the first trial was held against Johnson and Johnson but on the first day the case was settled for an amount that was not made public. After the first settlement, 5 more were settled in 2012.

Multiple offers are coming through from attorneys throughout the United States, by television advertising and online, to represent any men who took the drug and developed gynecomastia as a result. It is stated that there is a settlement in progress that may pay out large awards. However, this is not a class action lawsuit. A class action lawsuit settles for one amount that is divided equally among all claimants. Instead, the suit is termed a Multidistrict Litigation (MDL). An MDL is where all claims are heard by one judge in one courtroom.  Then each case is handled individually with each settlement negotiated by the plaintiff’s attorney, and may be based on the degree of injury.

To date, Johnson and Johnson have paid to the Department of Justice, 2.2 billion dollars due to a guilty plea by Janssen Pharmaceuticals for misbranding Risperdal.

The Philadelphia Court of Common Pleas now has over 1300 pending cases against Johnson and Johnson. In the meantime, there have been 3 bellwether trials. Bellwether trials give an indication of how juries react to testimony, and attorneys can use this information to help them negotiate future settlements.

The first bellwether case settled in February and due to the large settlement of 2.5 million dollars, made national news.  The settlement went to a man who is 20 years old and had been taking the drug for autism since he was 8 years old. The second bellwether case went in favor of the defendant due to lack of sufficient evidence that Risperdal actually caused gynecomastia. Recently the third bellwether case went in favor of the plaintiff but the amount of the settlement was undisclosed.

Male breasts are also known as gynecomastia and are caused by an abundance of glandular benign breast tissue. There are normal causes of breast development and some that are abnormal.

Normal but temporary breast development in males happens at birth, puberty and for the older man usually after the age of 50.

For male infants, there is a conversion of hormones from androgenic to estrogenic by the placenta; however the breast development usually subsides within a few weeks. For young males when they reach puberty, due to the changing levels of hormones, they may develop fullness in their breasts and/or puffy nipples. This is most disturbing for adolescent young men, but for 90-95% it is temporary and resolves within a few months to a couple of years. There are many men that develop gynecomastia after they reach age 50, as their testosterone levels start to drop. Male breast reduction surgery is an option for the older man and even for the adolescent boy if his breasts are causing him psychological problems.

Also, some prescription drugs, alcohol, marijuana, anabolic steroids, chemotherapy and dialysis are more common causes of gynecomastia.

There are uncommon causes for the development of the male breast that men should be aware of, such as Klinefelter’s syndrome and Grave’s disease. Even though breast cancer in men is very rare with only 1% attributed to all breast cancers, the incidence is 50 times higher for men with Klinefelter’s syndrome.

After World War II, it was noted that prisoners of war had a high incidence of developing gynecomastia. When malnourished, men’s testosterone level drops but estrogen continues to be produced, causing an imbalance of hormones. After men had been on a normal diet, many noticed the development of breasts, this phenomena is referred to as “refeeding gynecomastia.” For most men, their chest returned to normal within a few months to a couple of years.

There have been cases of topical lotions and oils that are believed to have an effect on the development of breasts in young men. In particular, lavender oil and tea tree oil have come under scrutiny. It is believed that these oils may inhibit the action of androgens, but in a report from National Institute of Health (NIH), more research needs to be done to support these theories.

Determining the cause of gynecomastia can be very frustrating, and the cause may never be known. It is more important to be seen by a Board Certified Plastic Surgeon that specializes in gynecomastia for an evaluation.

Gynecomastia Revision Needed, Is It Time For a New Surgeon?

Sometimes a revision can be something minor such as tightening up some redundant skin or easing of a fold in the nipple/areola. These type of corrections usually can be done as an office procedure and sometimes need to be done as a secondary procedure. If the cause of the revision gives the patient some concern, a frank discussion with the surgeon is warranted.
